OSHA Issues a Temporary Halt of the Implementation of Biden’s Vaccine Mandate
On Wednesday The Occupational Safety and Health Administration (OSHA) announced its decision to temporarily suspend its implementation and enforcement of Biden’s mandate ordering companies with more than 100 employees to develop a COVID-19 policy by Jan. 4. OSHA issued the following press release on its website:
“The court ordered that OSHA "take no steps to implement or enforce" the ETS "until further court order." While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation.”
The OSHA suspension of the implementation of the mandate follows a New Orleans 5th Circuit Court of Appeals opinion that OSHA’s mandate is “staggeringly overboard,” while ordering it to “to take no steps to implement or enforce the mandate until further court order.” On Nov 6 a temporary halt to the mandate had been previously issued, pending litigation.
