DOJ Applies Post-Enron Felony Law to Prosecute Jacob Chansley and Other Jan. 6 Protesters
For the first time ever, The Department of Justice used the post-Enron law, a felony which is punishable by up to 20 years in prison and was not intended to be used against political protesters. This unprecedented use of the law was applied to at least 220 Jan. 6th protester cases.
On November 17 District Court Judge Royce Lambert sentenced Jacob Chansley to serve 41 months for his involvement in the January 6 protest at the Capitol building. Chansley pleaded guilty to one count of obstruction of an official proceeding, which happens to be a felony applied to at least 220 other Capitol protester cases.
On Nov. 29, after a week of confusion over which attorney was representing him, Chansley confirmed to Judge Lamberth that he wanted John Pierce, former attorney for Kyle Rittenhouse, to replace Albert Watkins as his lawyer, according to a Talking Point Memo report. The report also noted: “in a statement last week, Pierce said Chansley would pursue “all remedies available to him” with respect to the outcome of his case — including a potential appeal of his conviction and a claim of “ineffective assistance of counsel.”
While various left-wing media sources have dubbed Chansley as the “QAnon Shaman,” it appears that he had no previous ties with QAnon, a key argument that his previous attorney Watkins failed to stipulate in the case.
