Benefits for Illegal Aliens on the Chopping Block as President Trump Signs Executive Order to Protect Taxpayers

To prevent illegal aliens from getting public benefits in an incorrect manner, President Trump signed an executive order last Wednesday. All federal departments and agencies are required by the Executive Order "Ending Taxpayer Subsidization of Open Borders" to identify any programs that receive federal funding and offer benefits to illegal aliens and to take appropriate corrective action.
The Executive Order cites the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) of 1996, commonly referred to as the Welfare Reform Act, as its legal basis. President Bill Clinton signed that measure, which set stringent requirements that foreign nationals must meet to be eligible for benefits. "The plain text of Federal law...generally prohibits illegal aliens from obtaining most taxpayer-funded benefits," the Executive Order says, referring to PRWORA. In particular, 8 U.S.C. 1641 typically restricts "qualified aliens" from being eligible for federal public benefits. Lawful permanent residents (LPRs), asylum seekers, refugees, aliens given parole for a minimum of one year, aliens whose deportation is withheld, and Cuban and Haitian immigrants are all considered qualified aliens by the law.
PRWORA not only restricted access to federal public benefits to "qualified aliens," but it also mandated that the majority of qualified aliens wait five years before they could petition for federal public assistance. Refugees, asylees, and Cuban and Haitian immigrants are a few exceptions that have gained significant attention in the past four years.
The Biden administration has also treated illegal aliens like legal immigrants for the last four years by taking advantage of legal loopholes. The widespread misuse of parole authority served as the primary means of doing this, with unauthorized Temporary Protected Status (TPS) grants serving as a secondary weapon. Despite having no legal status in the US, these abuses gave illegal aliens access to numerous benefit programs based only on their "lawful presence." Many illegal aliens were able to obtain government benefits like those of legal immigrants thanks to parole.
According to President Trump's Executive Order, giving illegal aliens unfair governmental benefits encourages illegal immigration and ought to be stopped. Thus, the Executive Order instructs all agencies and departments to:
Identify federally funded programs permitting illegal aliens to receive any benefits and to take steps to align those programs with both the intent of the Executive Order and federal law;
Ensure that federal funds being provided to states and local jurisdictions do not encourage illegal immigration or support sanctuary policies; and
Improve eligibility systems so that taxpayer benefits are not being improperly provided to illegal aliens.
The Order further directs the Office of Management and Budget (OMB) and the Department of Government Efficiency (DOGE) to identify any remaining streams of federal funding used to support illegal aliens and recommend further actions to increase eligibility verification and align federal spending with the Executive Order. Finally, the Executive Order instructs all agencies and departments to report any inappropriate uses of federal funds to the Department of Justice (DOJ) and Department of Homeland Security (DHS).
The gross cost of illegal immigration was anticipated by FAIR to be at least $182 billion in 2023, an increase of almost $50 billion since 2017. Costs associated with around 15.5 million illegal aliens and over 5.4 million illegal aliens' citizen offspring served as the basis for the calculation.
