Obama-Appointed Judge Indira Talwani Blocks President Trump’s Efforts to End Biden Admin Policy

The Trump administration is unable to quickly revoke the legal status and work permits of over 530,000 migrants who entered the country through President Joe Biden's contentious CHNV parole program; a federal judge has intervened to prevent this.

The president's attempt to terminate Biden's CHNV parole program was thwarted by Obama-appointed Judge Indira Talwani. During Biden's administration, more than 530,000 people from four different nations were able to enter the United States through air travel with temporary legal status. The judge ruled that further procedure is necessary, despite the Trump administration's claims that it was only reversing Biden's use of executive power.

President Trump's attempt to undo Biden's mass parole of Cubans, Haitians, Nicaraguans, and Venezuelans is temporarily halted by Monday's judgment given by Judge Indira Talwani, an Obama-era nominee. Under Biden's executive immigration authority, these migrants were airlifted into the United States and granted two years of residence with American sponsors.

In the final decision, Judge Talwani stressed that the government could not mass-cancel the migrants' status without conducting individual reviews of each case. "The Termination of Parole Processes... is hereby STAYED," she said, referring to the Trump administration's directive from March 25. All CHNV migrants whose temporary legal status was about to expire on April 24 will be protected by the verdict.

Starting in 2022 with Venezuelans, the Biden administration expanded the CHNV program to three more countries in 2023. Despite its promotion to decrease unauthorized entries at the southern border, the program swiftly sparked worries regarding screening procedures and security measures. The program was temporarily halted following allegations of extensive fraud. Several parolees were subsequently apprehended for horrific offenses, such as sexually abusing children.

The Trump administration's criticism of the judge's ruling reveals a political double standard. An anonymous senior source told Fox News, "It is pure lawless tyranny" because, while Biden could use his executive power to start the program, Trump is now unable to do the same to stop it.

Migrants and their families were able to fly straight into U.S. cities under Biden's program, bypassing the border altogether. Now that the legal hurdle has been crossed, the Trump administration will have to assess each case individually before deporting these individuals. The result would be a huge bureaucratic task that may take months, if not years, to complete. The migrants are currently required by DHS to depart the nation no later than April 24. As a result of the ongoing legal proceedings, that timeframe is still uncertain.

This new information further inflames the already heated discussion on executive overreach and how America will handle immigration enforcement after Biden leaves office. Liberal judges persist in erecting legal roadblocks to impede President Trump's agenda, despite his pledges to restore order and resume border wall building.
